MSLAA Membership Form

This allows us to update our database with the most current contact / license information for every Surplus Lines Producer.  This has to be mailed in by January 1 every year.  If you are a NEW SL Producer in Montana, send a copy of your Montana Surplus Lines license with your first submission form.

Montana Surplus Lines Submission Form    (Non-Interactive Printer Friendly Version)

This form has to be filled out completely for every policy or binder submitted to MSLAA.  It is not to be used for endorsements or cancellations.  The original document has to be submitted to the stamping office with an attached declaration page or binder. Please use the Interactive Form or Type all text when filling the Non- Interactive form out.  Handwriting is too difficult to read at times.

Endorsements and Cancellations Cover Note

This is REQUIRED with every endorsement / audit / cancellation that is submitted to the Stamping Office.  The endorsement / audit / cancellation will be sent back to the SL Producer if it is not attached to the documentation.  MCA 33-2-308

 

(ARL) Approved Risk List or White List

ARM 6.6.2809 - the list shall constitute a conclusive presumption within the meaning of 33-2-302, MCA, that any kind of insurance appearing thereon cannot be obtained from authorized insurers and does not require a diligent search by a licensed surplus lines insurance producer.

 

 

Surplus Lines Companies Eligible in Montana

This list is provided by the Department of Insurance approximately every 6 months.  It lists all insurance companies that are eligible to conduct surplus lines business in the state of Montana.  If your company is not on the most current list then you cannot write the risk legally in Montana.

Surplus Lines Disclosure Form -  Only required for the 10% AND $1500 exception

MCA 33-2-302(2) - A contract of insurance may not be placed with an unauthorized insurer under subsection (1)(d)(i) unless the unauthorized insurer is the equivalent of A-rated or better and the unauthorized insurer or the surplus lines insurance producer that placed the contract of insurance with the unauthorized insurer has provided the insured with disclosure information in a form and content approved by the commissioner

This is a free service to find out if the company you are using for the 10% AND $1500 exception is financially stable and meets the required “A” or higher rating.  You may have to register to get the service.

The Montana Insurance Department worked closely with the Montana Surplus Lines Agents’ Association, MSLAA, and the Independent Insurance Agents’ Association of Montana, IIAM, to draft and propose House Bill 631 in this year’s session of the Montana Legislature.


HB-631 amends
33-2-302 with a goal of increasing access to the surplus lines market and increasing consumer choice while continuing to ensure consumer protection.  This calculator was developed to take any confusion out of determining whether or not you are eligible to utilize this exception when writing surplus lines in Montana.
